Terms of service

These Terms of Service explain the rules that apply when you access or purchase from the Tan Theory website.

Throughout these terms, “Tan Theory”, “we”, “us” and “our” refer to Tan Theory. “You” and “your” refer to the person accessing the website or placing an order.

By using this website or placing an order, you agree to these Terms of Service. Please read them carefully before making a purchase.

About Tan Theory

Tan Theory operates the website tantheory.co.uk and sells products to customers within the United Kingdom.

You can contact us at:

Email: support@tantheory.co.uk

Our Terms of Service should be read alongside our Privacy Policy, Shipping Policy and Returns and Refund Policy.

Website use

You may use this website only for lawful personal or business purposes.

You must not:

  • misuse, damage or interfere with the website;
  • attempt to gain unauthorised access to the website or its systems;
  • upload malicious code, viruses or harmful material;
  • use automated tools to copy, scrape or reproduce website content;
  • provide false, misleading or fraudulent information;
  • place orders using payment details you are not authorised to use; or
  • use our products, branding or website content for unlawful purposes.

We may restrict or suspend access to the website where we reasonably believe it is being misused.

Age requirements

You must be at least 18 years old to purchase any age-restricted or adult-use product offered through our website.

By placing an order for such a product, you confirm that you meet the applicable age requirement and that the information provided during checkout is accurate.

We reserve the right to cancel an order where we are unable to confirm eligibility or where we reasonably suspect that an order has been placed by or on behalf of a person who does not meet the required age.

Product information

We make reasonable efforts to ensure that product descriptions, photographs, prices, ingredients, quantities and other information displayed on the website are accurate.

However:

  • colours and packaging may appear slightly different depending on your screen;
  • product packaging may occasionally be updated;
  • minor variations may occur between batches; and
  • images may be used for presentation purposes and are not always shown to scale.

Please read the product description, ingredients, directions, warnings and packaging before purchasing or using any product.

Nothing on our website should be treated as medical advice. Product information is provided for general information only.

Product suitability and use

You are responsible for checking that a product is suitable for you before use.

Always:

  • read and follow the instructions provided;
  • observe all warnings and precautions;
  • perform a patch test where advised;
  • stop using a product if irritation or an adverse reaction occurs; and
  • seek appropriate professional advice where necessary.

Do not use a product in a way that is inconsistent with its stated purpose or directions.

Products that do not contain SPF do not provide protection from UV exposure. You remain responsible for using suitable sun protection and following safe tanning practices.

Orders

Submitting an order does not automatically mean that we have accepted it.

After checkout, you will normally receive an order acknowledgement. A binding contract is formed when we confirm acceptance of the order or dispatch it.

We reserve the right to refuse or cancel an order where:

  • an item is unavailable;
  • the price or product information contains an obvious error;
  • payment has not been authorised;
  • fraud or misuse is suspected;
  • delivery is unavailable to the address provided;
  • the order breaches purchase limits; or
  • we reasonably believe the order would place us in breach of a legal or regulatory requirement.

Where payment has already been taken for a cancelled order, the relevant amount will be refunded.

UK online sellers must provide customers with key information about the product, price, delivery, cancellation rights and business before the sale is completed.

Prices and payment

All prices are displayed in pounds sterling (GBP).

The total payable will be shown at checkout before you place your order and may include:

  • the product price;
  • delivery charges; and
  • any applicable taxes or other charges.

We may change prices at any time, but changes will not affect an order that has already been accepted.

Payment must be made using one of the payment methods offered at checkout. You confirm that you are authorised to use the chosen payment method.

Discount codes:

  • must be entered before checkout is completed;
  • cannot be exchanged for cash;
  • may be limited to particular products, dates or customers;
  • cannot normally be combined unless stated otherwise; and
  • may be withdrawn or cancelled where they are misused.

Availability and purchase limits

All products are subject to availability.

Adding an item to your basket does not reserve it. We may introduce reasonable purchase limits where stock is limited or where we suspect commercial resale, fraud or misuse.

Where an ordered item becomes unavailable, we will contact you and provide an appropriate refund.

Delivery

We currently deliver only to eligible United Kingdom addresses shown at checkout.

Available delivery services, charges and estimated timeframes will be displayed during checkout.

Any delivery timeframe is an estimate rather than a guaranteed delivery date unless expressly stated otherwise.

We are not responsible for delays caused by circumstances outside our reasonable control, including carrier disruption, severe weather, industrial action, incorrect address information or events affecting transport networks.

You are responsible for providing a complete and accurate delivery address. Additional charges may apply if an order must be resent because incorrect details were provided or the parcel was not collected.

Risk in the goods passes to you when the order is delivered to you or to a person identified by you to receive it.

Cancellations, returns and refunds

Returns, cancellations and refunds are governed by our separate Returns and Refund Policy, which forms part of these Terms of Service.

Nothing in these terms limits your statutory rights where goods are faulty, damaged, incorrect, misdescribed or otherwise do not meet legal requirements.

For most UK distance sales, customers generally have 14 days after receiving goods to communicate a cancellation, subject to legal exceptions. Certain sealed goods may lose the cancellation right after being unsealed where they are unsuitable for return for health-protection or hygiene reasons.

Where required by law, goods must be of satisfactory quality, fit for purpose and as described. Consumer rights cannot be removed through unfair contract wording.

Damaged, faulty or incorrect orders

Please inspect your order after delivery.

Contact hello@tantheory.co.uk promptly if an item is:

  • damaged;
  • faulty;
  • missing;
  • incorrect; or
  • not as described.

Please provide your order number and clear photographs where possible.

We will assess the issue and provide an appropriate remedy in accordance with applicable consumer law.

Promotions and competitions

Promotions, giveaways and competitions may be subject to additional terms.

Where additional conditions apply, they will be displayed with the relevant promotion and will form part of these Terms of Service.

We may withdraw or amend a promotion where necessary, provided doing so does not unfairly affect orders already accepted.

Reviews and user content

Where you submit a review, photograph, comment or other content, you confirm that:

  • it is accurate and based on your genuine experience;
  • you own it or have permission to submit it;
  • it does not infringe another person’s rights;
  • it is not defamatory, threatening, offensive or unlawful; and
  • it does not contain malicious code, spam or misleading claims.

You grant Tan Theory a non-exclusive, royalty-free right to display, reproduce and use content you voluntarily submit for website, customer-service and marketing purposes, subject to applicable privacy and advertising laws.

We may remove content that breaches these terms.

Intellectual property

The website and its content, including the Tan Theory name, logo, product names, photographs, graphics, text, designs and layout, are owned by or licensed to Tan Theory.

You may view and use the website for personal, non-commercial shopping purposes.

You must not copy, reproduce, modify, distribute, sell or commercially exploit our content without written permission.

Third-party services and links

Our website may contain links to third-party websites or use services supplied by third parties, including payment providers, delivery companies and social-media platforms.

We are not responsible for the content, availability or privacy practices of independent third-party websites.

Your use of a third-party service may also be subject to that provider’s own terms.

Privacy and marketing

Personal information is handled in accordance with our Privacy Policy.

Marketing emails or messages will only be sent where permitted by law. You can unsubscribe using the link within a marketing email or by contacting us.

Marketing communications must identify the business and applicable promotional conditions, and electronic marketing to individuals generally requires appropriate consent or another lawful basis under the relevant rules.

Limitation of liability

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation; or
  • rights and remedies that cannot legally be excluded.

Subject to the above, we are not responsible for losses that were not reasonably foreseeable when the contract was formed.

Where you purchase as a consumer, we supply products for domestic and private use. We are not liable for business losses, including loss of profit, revenue, opportunity or goodwill.

We are not responsible for loss caused by:

  • using a product contrary to its instructions or warnings;
  • failing to check ingredients or suitability;
  • unauthorised modification or misuse;
  • information supplied incorrectly by the customer; or
  • circumstances outside our reasonable control.

This section does not reduce your statutory consumer rights.

Events outside our control

We will not be responsible for delay or failure caused by an event outside our reasonable control.

Where such an event affects an accepted order, we will contact you where reasonably possible and take appropriate steps to reduce the effect of the delay.

Changes to these terms

We may update these Terms of Service from time to time to reflect changes to our website, products, business practices or legal obligations.

The version that applies to your purchase is the version in force when your order is placed.

The latest revision date will appear at the top of this page.

Severability

If any part of these terms is found to be unlawful or unenforceable, the remaining sections will continue to apply.

No waiver

If we delay enforcing any right under these terms, that does not mean we have waived that right.

Governing law

These Terms of Service and any contract between you and Tan Theory are governed by the laws of England and Wales.

Consumers living elsewhere in the United Kingdom may also benefit from mandatory protections and may be entitled to bring proceedings in the courts applicable to where they live.
